Project Description: Construction of a new 2-story, 12-unit multifamily apartment building with associated parking and landscaping on a vacant 2.04-acre parcel at 620 S. Central Ave.
Current Status: The project was originally approved in September 2021 as an affordable housing development. The new owner intends to build the exact same physical project (design, layout, height) but as market-rate housing due to financing constraints and market conditions.
Key Issues and Analysis
Parking Requirements & Assembly Bill 2097
In 2021, the project received a reduction in required parking spaces because it was designated as "affordable." Typically, removing the affordable status would require adding more parking. However, the staff report notes that Assembly Bill 2097 (AB 2097) now prohibits cities from enforcing minimum parking requirements for developments within 0.5 miles of a major transit stop.
Significance: Since this project qualifies under AB 2097, the previous parking reduction is now standard law, regardless of affordability status. This effectively eliminates a major redesign requirement that would have been necessary before this law was enacted.

Rationale for Removing Affordability Requirement
- Not Core to Design: The affordability condition was included in the 2021 conditions but was not fundamental to SPARC's design and site-planning findings.
- Ownership Change: The project changed ownership and experienced cost and market pressures.
- Current Market Conditions: The current owner can proceed only as a market-rate project due to financing constraints.
- Housing Supply Benefit: Even as market-rate, the development will add to the City's overall housing supply and moves the City toward meeting its Regional Housing Needs Allocation (RHNA) obligations.
- Infill Preference: For an already-approved infill project, allowing it to proceed is preferable to it remaining unbuilt.
Environmental Review
No additional CEQA (California Environmental Quality Act) review is required. The project was previously found to qualify for the Class 32 (Infill Development) exemption under CEQA Guidelines Section 15332, and the current action does not modify the physical development, intensity, or environmental setting of the project. The request is limited to revision of conditions of approval.

"I move that the Site Plan and Architectural Review Committee approve the revised Conditions of Approval for Site Plan and Architectural Review Application No. PL2021-007, to remove the prior affordability requirement, reaffirm the previously approved street-side setback deviation appropriate for this infill site, and acknowledge that parking minimums are no longer applicable pursuant to AB 2097. All other conditions of approval shall remain in effect."

Right of Appeal
If you disagree with the decision of the committee, you have a right of appeal. Only persons who participated in the review process by submitting written or oral testimony, or by attending the public hearing may appeal.
Appeal Process: Pursuant to Lodi Municipal Code Section 17.70.050, actions of the Site Plan and Architectural Review Committee may be appealed to the Planning Commission and then to the City Council by filing, within ten (10) business days, a written appeal with the City Clerk and payment of $300.00 appeal fee.
